This Privacy Policy governs the processing of personal data by Woerwag Pharma Polska Sp. z o.o.

The administrator of personal data is Woerwag Pharma Polska Sp. Z o.o. based in Warsaw, 1 Dziekońskiego St., (hereinafter referred to as "Administrator").The Administrator takes care of the security of personal data processing. The Administrator processes only such data that is permitted by law and to the extent necessary to achieve the purpose of processing. Personal data collected by the Administrator shall be processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), also referred to as "RODO".

Purpose and legal basis of data processing

Our websites may process data that does not include your contact information, but could be used to identify the specific device through which you access the service. However, in combination with other data, the data we acquire could be used to identify the user. In this way, we could obtain, for example: demographic data, IP addresses and Internet identifiers, as well as data obtained from cookies. We use the data obtained in this way to enable us to identify the user's session, to customize the content displayed, and for statistical purposes.

Also, depending on the nature of the relationship, we may collect various categories of personal data provided directly by users. The scope of the data depends on the nature of the relationship and may include such data as Name, address and contact details, data confirming membership in a specific professional group. We may process users' personal data for the following purposes:

  • Authorization and granting of access to our resources,
  • Enabling registration for events organized by us,
  • Ordering services (e.g. newsletter),
  • Administration of our services,
  • Providing legal compliance and security of operation of our services,
  • Conducting statistical analysis.

In certain situations, providing your personal data may be necessary.

Legal grounds for data processing

The legal basis for processing personal data may be:

  • Consent provided by you (Article 6(1)(a) of the RODO): In certain situations, we may ask for your consent to use your personal data. The purpose of data use is always stated in the consent. Consent granted may be withdrawn at any time, either through the dedicated functionality of our services or by contacting us as described below. Please note that the withdrawal of consent does not affect the lawfulness of the processing performed on the basis of consent before its withdrawal. 
  • The necessity of processing for the performance of a legal obligation or for the performance of a contract (Article 6(1)(b) and (c) RODO): Under certain circumstances, we may have an obligation to process your personal data to comply with the law or to fulfill our obligations under a contract to which you are a party. 
  • Realization of our legitimate interests (Article 6(1)(f) RODO): Such legitimate interests are: conducting communications with users, ensuring the security of our services, and conducting statistical analysis and archiving data to meet accountability requirements.

Data retention period

The administrator will keep the acquired personal data for the period resulting from the relationship with the user, for the time necessary to fulfill the purposes for which the data were collected, and, after the purpose of the processing has ceased, for the period specified in the regulations and necessary for the establishment, investigation or defense of claims, or if the obligation to store them arises from the law.

Data disclosure

Administrator, as a rule, does not share user data with other entities, unless the obligation to do so arises from the law (e.g., disclosure at the request of authorized authorities) or is necessary for implementation and is done at the request of the user (e.g., in the case of registration for events organized by external providers).

Access to user data may be provided by entities providing services to the Administrator (subcontractors and suppliers), including those providing technical support for the operation of our services.

Access to user data contained in cookies may be provided by the publishers of such cookies.

Transfer of data to third countries

Some recipients of data may be located outside the European Economic Area, not providing an adequate degree of protection ("Third Country"). In any case, such transfer shall only take place using the appropriate safeguards associated with such data processing, including in particular an agreement with the data recipient using the Standard Contractual Clauses approved by the European Commission.

Automated data processing

Personal data of users will be processed by automated means (including profiling), however this will not have any legal effect or similarly materially affect the users. Automated processing, including profiling, may consist of analyzing and evaluating user data in order to adapt the behavior of the services to the configuration of the device and software the user is using as well as to the user's preferences.

Users' rights

In connection with the processing of personal data by Woerwag Pharma Polska Sp. Z o.o., users have a number of rights. We ensure that all users' rights under RODO and other laws are respected:

1. Right of access to personal data - Any user may request information about what personal data we process, including receiving a copy of their personal data.
2. Right of rectification of personal data - A user may request correction of data that is incorrect or completion of data that is incomplete.
3. Right to erasure of personal data ("right to be forgotten") - The user may request the erasure of all his/her data in certain cases, including the withdrawal of consent to its processing (if it was the only basis for processing) or if the data was processed unlawfully. Important! The User will not be able to exercise this right when the processing of data results from the fulfillment of legal obligations and when the processing is necessary for the establishment, investigation or defense of claims.
4. Right to object - The User may, at any time, request that the processing of data be stopped for reasons related to his/her particular situation in the event that the User's data is processed for purposes arising from legitimate interests (e.g. for statistics and analysis). In such a case, the Administrator will stop processing personal data unless there are valid and legitimate 1 grounds for processing overriding the interests, rights and freedoms of the user or 2 grounds for establishing, asserting or defending claims.
5. Right to restrict processing of personal data - The user may request "blocking" of data (i.e. stopping data processing operations beyond storage) in certain situations, including for the time necessary to correct the data or when the data is no longer needed, but storage is needed by the user, e.g. to protect his/her rights.
6. Right to portability of personal data - The user may request to receive the data he/she has provided in a structured, commonly used machine-readable format. The user may request to obtain this data or send it directly to another designated controller, if technically possible.

In addition, in the event of a suspected violation of personal data protection regulations, the user has the right to file a complaint with the President of the Office for Personal Data Protection.
